Portuguese EPR, explained.

Extended Producer Responsibility, or EPR, gives the producer financial and operational responsibilities for the waste phase of certain products. In Portugal, packaging, electrical and electronic equipment and batteries are distinct flows, regulated by Decree-Law no. 152-D/2017 and registered in SILiAmb.

There is no answer just based on the name of the brand or store. The entity, the establishment, the D2C or B2B channel, the contracts, the importer and who places the first place in the Portuguese market must be analyzed.

For direct distance sales to final users in Portugal—consumers or businesses buying for their own use without resale—an authorised representative is mandatory for a company not established in Portugal. For sales to Portuguese distributors or importers that resell, an EU/EEA company may appoint a representative voluntarily; a third-country company cannot use this route to replace the liable Portuguese operator. Mixed flows require manual review by channel.

The basis is the bilingual PT/EN mandate aligned with Annex VII, the extract from the commercial register that shows who can bind the company and, if someone else signs, a simple power of attorney. Documents in Portuguese or English are processed directly; other languages ​​follow with the original and an uncertified translation.

The APA designation is not retroactive, so prior periods must be identified honestly.

SILiAmb is the APA platform that includes the Producer/Packer Registration module. Registration is handled per stream, so an entity with packaging, electrical equipment and batteries may have several numbers. For WEEE, the documented form is PT followed by six digits. For packaging and batteries, PT followed by eight or nine digits is accepted only after review of the certificate or final authority evidence; the product never invents a number.

The official guidance referred to in the dossier indicates that the APA does not charge a registration fee. This does not eliminate private service fees, contributions to the producer responsibility organisation or other external costs, which are presented separately.

A management entity organizes the collective compliance of the flow and collects contributions according to the contract and the quantities. Sociedade Ponto Verde, Novo Verde and Electrão operate in the context of packaging. Electrão is only the hypothesis of configured work; the actual choice depends on confirmed license, categories, contract and payment circuit.

According to FAQ 1.28 of APA, the authorised representative maintains responsibility for the producer’s obligations and, by default, concludes the contract with the managing entity, declares and executes the payment. The producer may only execute the payment by means of a tripartite contract or a representative contract–management entity to which the producer–representative agreement is attached. These ways alter the execution of the payment do not in itself transfer the representative’s responsibility. Acceptance by the chosen managing entity and final contractual wording require human verification and review before activation.

There is no general low-volume registration exemption. Below 1,000 kg, Electrão’s 2026 RAPD table limits the contribution to the lower of €125/year and the normal-regime calculation; the amount depends on urban or non-urban classification, materials, ecomodulation, and the confirmed contract.

The base rule configured for the portfolio act in SILiAmb is March 31, with correction for the previous year and estimate for the current year. The exceptional extension from 2026 until April 30 does not change the permanent rule. The January 31st cutoff used with clients is an internal contractual rule, not a legal deadline.

The representative submits the represented producers in a single act. All included members require complete data, review and approval. Any deletion, suspension or correction requires a reason, authorization and an audit trail.

When a producer also sells to Portuguese distributors, the annual review includes each distributor, the Portuguese NIF and the quantities per material. Subtotals must reconcile with flow totals.

No. The currently known program does not constitute a Portuguese registration route. We also do not claim that Amazon already checks all sellers uniformly; the platform maintains its own fields, deadlines and decisions.

Regulation (EU) 2025/40 introduces requirements for producer verification by online platforms from that date. The text does not transform eprportugal.com, the APA, or a platform into the same entity, nor does it guarantee when a platform will implement a field or accept a document.
